About LHRC Constitutional Database

This is a Public web based database on Constitutional Making and Constitutionalism in Tanzania and other Jurisdictions. For Tanzania, this is a one stop centre database on the history of constitution and constitution making in the United Republic. This database has been formed specifically to be accessed by all citizens and interested scholars abroad on the constitution history of URT. The database provides missing literature review in so far as Constitutionalism is concerned.
Tanzania is in the process of the new Constitution making since December 31st 2010 when his excellence the President of the United Republic of Tanzania, Mr. Jakaya Mrisho Kikwete announced that Tanzania will have to write a new constitution. The statement was a resulted of un-satisfaction of the current United Republic Constitution of 1977 by Human Rights Activists and Politicians.
The Legal and Human Rights Centre was among the key players to advocate for a new constitution since 1998 when it coordinated the Civil Society countrywide and formed a network which was known as Citizens Coalition on the New Constitution (CCNC). However, none or very few of the activism by Civil Society or Political Parties were documented. Furthermore, there is no documentation by the Government itself on constitutionalism in Tanzania pre-independence, independence and post independence as well as the current process since the President announced the commencement of it.
LHRC decided to establish a Public Database on the Constitutional Matters in Tanzania. This is expected that it will better serve as a lesson to contemporary and future generations if every step thereof, is well monitored and carefully documented. Africa has been a victim of the lost information about its past; hence failing to carefully plan for its own future. Now as this process is meant to be a lesson, its documentation and preservation of all related information remains inevitable.

Description of the Database

This database is a comprehensive collection of all sorts of data/information on/ or related to constitution making in the United Republic of Tanzania (URT). The information this database includes all such constitutional and related materials as can be available since the colonial era to date. In that case will include, all necessary constitutional documents adopted by the colonial state, the independent Tanganyika, peoples republic of Zanzibar and eventually the United Republic of Tanzania. The information collected under this database specifically includes:
  1. The authentic texts of the constitution of URT including all amendments done.
  2. Hansards and all preparatory materials created in the cause of adopting all such constitutions stated herein above.
  3. Information on political and social economic settings at all times during the enactment of the constitution and amendments, which drove the changes.
  4. Publications by prominent constitutional experts including critics, commentaries, compendia.
  5. The database contains analysis of issues from various academicians, practitioners, scholars and any other such co-opted individuals. Issues raised or addressed by politicians (past and present) that has been collected to inform on the constitution development of URT.
This database is a user-friendly and accessible and helpful to local and international researchers, students, media houses, politicians and members of public generally. It serves as a platform for various scholars to contribute their works for bringing and sustaining positive change for the sake of ensuring social justice, accountability and betterment of the people in Tanzania, East Africa and Africa in general.
